Butlers in the Buff™ Wins Trademark Infringement Case
Butlers in the Buff, the original ‘male’ order company, has been awarded damages and costs as an outcome of their win in a trademark infringement case against copycat company ‘Bufflers’ and its owner Adam Davey, based in Newquay.
Butlers in the Buff launched the legal action following concerns that the imitation company was using their trademark brand name online without permission, which BITB claims created confusion for clients and the copycat company was ‘passing off’ as the authentic Butlers in the Buff brand.
The trademark infringement case was raised in August 2018, against Adam Davey, who trades as ‘Bufflers’, after BITB previously wrote to the company in 2017, to object the use of its registered marks but a blasé, non-complicit response was received.
The action sought to prevent the continued misuse of the Butlers in the Buff trademark across the internet. The copycat company were found to be unfairly taking advantage of the hard earn reputation and brand name of Butlers in the Buff who set up in business in 2001 creating the naked butler industry that hen party industry is synonymous with.
In October 2018, Butlers in the Buff settled out of court to restrict ‘Bufflers’ or anyone on its behalf from infringing the registered trademarks by using the marks or similar on their marketing literature and on their website.
Stacey Bramhall Director and Partner at Butlers in the Buff said:
“We are pleased with the outcome and will continue to protect our brand against other infringers. We have worked very hard to build our business up to what it is today. We are very proud of our fantastic brand. It is not right that other companies try to confuse the public by trying to pass off as ‘Butlers in the Buff. It is very unfair to our business but also and more importantly to the general public who believe they are booking a genuine Butler in the Buff.
Butlers in the Buff takes trademark infringement very seriously and is dedicated to protecting the brand. We continue to work closely with our lawyers Clarke Willmott LLP to maintain the integrity of the Butlers in the Buff brand and to curb any infringement of it, be that online or in person.”
Butlers in the Buff is the trading name for DJL Darwin Ltd, before Butlers in the Buff there wasn’t a naked butler industry and they are the nation’s favourite when it comes to hen & birthday party entertainment.
